The information below is written as a general guide and does not take into account individual circumstances of claimants. Incapacity Benefit: In October 2008, the Incapacity Benefit was replaced by a new benefit called Employment and Support Allowance. However, you can still claim Incapacity Benefit if you were already claiming it prior to October 2008; or your current condition can be linked to before October 2008; your doctor still assesses that you are not capable of work due to ill health and is providing you with sick notes. During your claim the benefit department will ask you to attend a medical assessment by one of their independent doctors. You will be scored points after the assessment and the number of points awarded will have a direct impact on whether you will be able to continue to receive the benefit. It is important that for those people who suffer from conditions such as an Acquired Brain Injury are supported/represented in the medical assessment. The medical examiners may not be able to appreciate the extent of someones incapacity to work should the claimant not be fully aware of their own situation.
