The Protection of Freedoms Bill was introduced in February 2011 and is currently progressing through the House of Lords, and is due to receive Royal Assent in early 2012. The Bill will have an impact on the role of the ISA and CRB as it plans to restrict the scope of the vetting and barring scheme and make changes to the current system of CRB checks.
The current ISA vetting and barring scheme will be scaled back, there will no longer to be a requirement to register with the ISA, nor will there be continuous monitoring of individuals. However there will be greater portability of CRB disclosures. Employees will be able to present an enhanced CRB certificate from previous employment and employers will then be able to apply for 'update information'.
The Bill seeks to establish a disclosure and barring service to replace the current CRB and ISA organisations, although it is thought that the staff and tasks of the two current offices will remain the same.
The Bill proposes that only one certificate should be issued by the CRB and that it should go directly to the individual rather than the employer so that the individual would be able to appeal any incorrect information on the certificate before presenting it to their employer. This is currently being debated in the House of Lords and there may be further changes to come.
