Policy Reform: Law Commission recommends reform of adult social care law The Law Commission has recommended that adult social care law should be reformed, when Government introduces legislation in 2012, with separate statutes for England and Wales containing core duties and powers of local social services authorities, supplemented by regulations and a code of practice on how eligibility criteria should be set, including a minimum level of provision. The statutes will contain an overarching purpose to promote the user's "well-being" and a set of factors to be considered when decisions are taken regarding that individual. The paper recommends that individual’s wishes and feelings should be the key factors in determining their living arrangements, direct payments should be extended to residential care and adult protection duties and powers clearly defined in the statute: Paper.
